It seemed necessary and illogical to have too formal

an exchange of notes seeing that all surplus revenues of railway are already, under loan agreement, ear-marked for service of ical, I accordingly, with concurrence of Governor of Hongkong and representative of British and Chinese Cor- poration, proposed to Minister of Railways that he should

merely address a note to the Governor confirming under-

taking of Chinese delegates that future surpluses consequent

on increased percentage to be assigned to Chinese section

would be ear-marked for service of loan which, under loan

agreement, was a first charge on earnings of the line.

Minister of Railways has now sent a message in reply,

claiming that it had been agreed between delegates that under-

taking regarding surplus should not be embodied in writing,

refusing accordingly to send note, but expressing willingness

to embody terms of my draft in a ministerial order to rail-

way and to send us a copy.

Subject to concurrence of Governor of Hongkong and

Corporation's representative I propose to accept this as

satisfactory.

Addressed to Foreign Office, repeated to Mission,

Hongkong, and Commercial Counsellor.
